Terms of Use

These Terms of Use govern access to the website www.interphone.com (hereinafter referred to as the "Site") and the services provided through the Site (collectively, the "Services"), and regulate their use.

These Terms of Use constitute a binding agreement between Cellularline S.p.A. ("we," "us," or "Cellularline") and the user.

THE SITE IS MANAGED BY CELLULARLINE S.P.A., WHICH ALSO OWNS IT, WITH HEADQUARTERS IN REGGIO EMILIA, VIA G. LAMBRAKIS N. 1/A, TAX CODE, VAT NUMBER, AND REGISTRATION NUMBER IN THE REGGIO EMILIA COMPANIES REGISTER 09800730963.

BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND IMPLICITLY AGREE TO COMPLY WITH THEM. IF YOU DO NOT AGREE, YOU MUST REFRAIN FROM USING THE SITE.

Cellularline reserves the right to periodically modify these Terms of Use at its sole discretion and without prior notice. In such cases, Cellularline will publish the updated version of the Terms of Use on the Site, replacing the "Last Modified" date with the update date. Users are encouraged to regularly review the Terms of Use. Continued use of the Site and Services after the modifications implies the user's acceptance of the updated version of the Terms of Use. If the user does not accept these changes, they must refrain from using the Site.

By accessing the Site or using the Services, the user warrants that they are legally capable of entering into this agreement.

Cellularline reserves the right to take the following actions at any time and without notice: (i) modify, suspend, or discontinue functionality or access to the Site or parts of it for any reason; (ii) modify or change the Site in whole or in part, as well as update policies; and (iii) suspend the Site's functionality or parts of it for regular or extraordinary maintenance, error correction, or other adjustments.

 

1. Privacy Policy

1.1 Use of the Site is governed by Interphone's Cookie and Privacy Policy (available at https://interphone.com/pages/privacy-policy), which is an integral part of these Terms of Use.

 

2. Intellectual Property Rights


2.1 The contents of the Site, including but not limited to the interface, trademarks, works, images, photographs, dialogues, music, sounds, videos, documents, drawings, figures, logos, and other materials in any format published on the Site, as well as menus, web pages, graphics, colors, patterns, fonts, the Site design, diagrams, layout, methods, processes, functions, and software present on the Site (collectively, the "Materials"), are protected by copyright laws and other intellectual property regulations and are owned by Cellularline or other rights holders.

 

3. Use of the Site


3.1 "Use" of the Site refers to the user's right to browse the website, view its contents, and perform only temporary reproduction acts considered transient or accessory, along with all other navigation operations carried out solely for lawful use of the Site and its contents.
Users are expressly prohibited from modifying, copying, using, reproducing, republishing, translating, transmitting, or distributing the Site, its contents, or Materials in any form or way without prior written consent from Cellularline.

3.2 Access to and use of the Site, including communication with Cellularline, is lawful provided that the user uses the information obtained from the Site solely for personal and non-commercial informational purposes and refrains from copying or publishing the information by any means.

3.3 The user shall refrain from using the Site or the Materials for illegal activities or activities prohibited by these Terms of Use, as well as from facilitating the execution of any unlawful activity or violating the rights of Cellularline or others.

3.4 The user acknowledges and agrees that Cellularline may retain any transmission or communication between the user and Cellularline through the Site or any Service offered on or through it and may also disclose such data if required by law or if such disclosure is necessary (i) to protect Cellularline's intellectual property, (ii) in the context of legal proceedings, or (iii) to respond to claims that the content of any communication violates the rights of third parties.

 

4. Liability for Site Use

4.1 The user is personally responsible for the use of the Site and its contents.

4.2 Cellularline shall not be held liable for any use of the Site and its contents that does not comply with applicable laws by its users. In particular, the user shall be solely and exclusively responsible for providing incorrect, false, or third-party information and data without their explicit consent, as well as for the improper use of such information and data.

4.3 The user is solely responsible for maintaining the confidentiality of their account data, including the password, as well as for any actions resulting from failing to keep such information confidential and secure.

4.4 The user is responsible for safeguarding and correctly using their personal information, including the credentials allowing access to reserved services, and for any damage or harm caused to Cellularline or third parties due to the improper use, loss, or theft of such information. The user must immediately inform Cellularline of any unauthorized use of their account or password, as well as any other security breach.

4.5 At no time is the user allowed to use other people's accounts without the explicit consent and authorization of their legitimate owner. Cellularline shall not be held liable for any losses or damages arising from the user's failure to comply with these obligations.

4.6 The user is solely responsible for any damage to computer systems or data loss resulting from content download operations and cannot hold Cellularline liable. Cellularline disclaims any responsibility for damages caused by the inaccessibility of the services available on the Site or by damages caused by viruses, corrupted files, errors, omissions, service interruptions, content deletions, network issues, providers, or telephone and/or telematic connections, unauthorized access, data alterations, or the failure and/or malfunction of the user's electronic equipment.

4.7 Cellularline does not guarantee that the Site or its content, services, or features will be error-free or continuously available, that any defects will be corrected, or that the user's use of the Site will produce specific results.
Cellularline cannot guarantee that documents or other data downloaded from the Site will be free of viruses or other defects.

4.8 CELLULARLINE SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SITE AND/OR THE SERVICES.

4.9 The user agrees to indemnify Cellularline, its officers, directors, shareholders, employees, agents, subsidiaries, and affiliates against any claims, damages, losses, liabilities, demands, or expenses (including legal fees) made against Cellularline by third parties, arising from or related to the user's use of the Site


5. Links to Other Sites

5.1 The Site may contain links to other websites. Cellularline has no control over such websites and is not responsible, nor can it be held accountable, for the accessibility of third-party websites or their content.

5.2 The presence of links to other websites, as well as references to information, products, or services of third parties in the links on the Site, does not constitute approval by Cellularline in any way or under any circumstances of the aforementioned websites, information, products, or services, nor can it be interpreted as such. Any questions or comments regarding these websites must be directed to their respective administrators.

5.3 Unless prior written consent is obtained from Cellularline, the user is not authorized to frame the Site within other websites or create links to any part or page of the Site and/or to the Materials or any part thereof.

 

6. Governing Law

6.1 These Terms of Use are governed by Italian law and must be interpreted accordingly, excluding private international law norms.


7. Miscellaneous

7.1 These Terms of Use constitute the entire agreement between the user and Cellularline regarding the use of the Site and replace any prior written or oral agreement between the user and Cellularline concerning such use.

7.2 No waiver by Cellularline of any breach or failure to comply with any of the obligations contained herein shall be considered a waiver of any subsequent and/or similar breach or failure.

7.3 If any provision of these Terms of Use is deemed invalid, illegal, or unenforceable for any reason, such invalidity or unenforceability shall not affect any other provision of these Terms of Use, which shall be interpreted as if such invalid, illegal, or unenforceable provisions were never included.
